CalRecycle Publishes Proposed Revisions to EPR Program Regulations

On May 16, 2025, the California Department of Resources Recycling and Recovery (CalRecycle) published its proposed draft regulations to implement the Plastic Pollution Prevention and Packaging Producer Responsibility Act (SB 54), the state’s Extended Producer Responsibility (EPR) scheme for single-use packaging and plastic single-use food service ware. The new draft regulations are intended to implement, make specific, and clarify CalRecycle’s final draft regulations from the rulemaking that began in March 2024, which were ultimately rejected by the California governor in March 2025. 

CalRecycle will hold an informal public workshop on the proposed regulatory text on May 27, 2025, at 10 a.m. The session will include an overview of the rulemaking process, a discussion of the substantive proposed changes to regulations compared to the final draft regulations from the first rulemaking, and updates to the fiscal and economic analyses. In addition, CalRecycle is soliciting public comments on the draft regulations through June 3, 2025.
