The U.S. House of Representatives will consider legislation to increase recycling accessibility in communities and improve recycling data collection when summer recess ends this month. The Recycling and Composting Accountability Act (RCAA), S.3743, would identify challenges, improve data collection, and determine best practices with respect to recycling and composting in America.

The Food Safety and Standards Authority of India (FSSAI) has taken further steps towards authorizing the use of certain recycled plastics in food-contact materials (FCMs) under its existing regulations.  FSSAI issued a Notification of Draft Regulations on May 17, 2022, inviting public comment on an amendment authorizing the use of recycled polyethylene terephthalate (rPET) in food-contact applications.

The Taiwan Food and Drug Administration (TFDA) announced on May 12, 2022, an application process for the use of recycled polyethylene terephthalate (rPET) chips and flakes in food containers and packaging manufacturing.

Following the April 21, 2022 meeting of the European Commission’s (EC) Standing Committee on Plants, Animals, Food and Feed (SC-PAFF), the EU Member States issued a draft joint statement regarding the presence of Mineral Oil Aromatic Hydrocarbons (MOAH) in food, directing the relevant competent authorities and food business operators to conduct sampling and to investigate the sources of MOAH in foodstuffs.

A recently introduced bill in New Jersey (Bill S2145/A1554) would prohibit the sale, distribution, and import of certain products and packaging marked as recyclable, unless the New Jersey Department of Environmental Protection (DEP) determines that the products are widely recycled.

The Thai Ministry of Public Health (MOPH) notified the World Trade Organization (WTO) of a proposal to revise standards for certain plastic food packaging. The draft proposal (WTO document 22-0680 notified under G/SPS/N/THA/484) would revise standards such as the overall migration limit, the restrictions for primary aromatic amines (PAAs), the migration limits for various metals, and the specific migration limits for certain types of food plastics as listed in Annex I. 

Maryland’s General Assembly is considering legislation that would establish an extended producer responsibility (EPR) program. The legislation, SB292 and HB0307, would require the Maryland Department of Environment (DoE) to conduct a statewide assessment by October 1, 2023, and every 10 years after that.
