The U.S. Food and Drug Administration (FDA) recently added four new substances to its Inventory of Effective Food Contact Substances (FCS) Notifications. The newly listed substances and the manufacturers are listed below.

On May 31, 2023, Washington State’s Department of Ecology (DoE) adopted a final rule under the state’s Safer Products for Washington Program, which includes a ban on bisphenol-based epoxy liners in drink cans and a reporting requirement for bisphenol-based epoxy liners in food cans. Tetramethyl bisphenol F (TMBPF)-based epoxy can liners are exempted from both the ban and reporting requirement. 

On April 19, 2023, the China National Center for Food Safety Risk Assessment (CFSA) published on its website a draft amendment to the GB 4806.1 National Food Safety Standard on the General Safety Requirements for Food-Contact Materials and Articles (Draft Standard). This is the first proposed amendment to the GB 4806.1-2016 Standard, which took effect in 2017. Once finalized, the updated GB 4806.1 Standard will impact industry compliance with China’s food-contact material (FCM) regulations.

On May 8, 2023, Oregon Governor Tina Kotek signed SB 543 into law. Effective January 1, 2025, the new law prohibits the sale or distribution of foodware containers with intentionally added per- or polyfluoroalkyl substances (PFAS), as well as the use by food vendors of polystyrene foam containers for prepared food.
