The U.S. Food and Drug Administration’s (FDA) most recent update of its Unified Agenda of Regulatory and Deregulation Actions was published on January 25, 2024. The latest version of the Unified Agenda gives a target date of April 2024, for publishing a rule to amend the food additive regulations to allow a Food Contact Substance Notification (FCN) to become no longer effective for reasons other than safety.

The U.S. Food and Drug Administration (FDA) recently added one new substance to its Inventory of Effective Food Contact Substances (FCS) Notifications. The newly listed substances and the manufacturers are listed below.

The U.S. Food and Drug Administration (FDA) published a notice of filing for a food additive petition that proposes amending certain food additive regulations to remove four solvents: benzene, ethylene dichloride, methylene chloride, and trichloroethylene. The food additive petition was submitted by the Environmental Health Defense Fund, the Breast Cancer Prevention Partners, the Center for Environmental Health, the Environmental Working Group, and Lisa Lefferts.

The petition proposes that FDA amend the following regulations to remove the use of the four specified solvents: 

CalRecycle released on December 28, the SB 343 Preliminary Findings Report for material types and forms that routinely become feedstock in the production of new products and packaging.

The California Department of Resources Recycling and Recovery (CalRecycle) announced that the

U.S. Senate bill S. 3387, “Ensuring Safe and Toxic-Free Foods Act of 2023,” would prohibit independent Generally Recognized as Safe (GRAS) designations and create an Office of Food Chemical Safety, Dietary Supplements, and Innovation. The bill was introduced by Senators Edward J. Markey (D-MA), Cory Booker (D-NJ), Richard Blumenthal (D-CT), and Elizabeth Warren (D-MA) on December 4, 2023.

The U.S. Food and Drug Administration’s (FDA) recently released final guidance, titled, “Registration and Listing of Cosmetic Product Facilities and Products,” provides information to be included with registration and listing submissions required under the Modernization of Cosmetics Regulation Act of 2022 (MoCRA).

On October 27, 2023, California’s Office of Environmental Health Hazard Assessment (OEHHA) issued a Proposed Rulemaking to amend the warning requirements under Proposition 65 (otherwise known as the Safe Drinking Water and Toxic Enforcement Act of 1986).  The proposal, if enacted, would revise both the standard long-form and short-form warning requirements, as well as the warning requirements for products purchased from the internet or from catalogs.  More information on the prop
