U.S. Senate bill S. 3387, “Ensuring Safe and Toxic-Free Foods Act of 2023,” would prohibit independent Generally Recognized as Safe (GRAS) designations and create an Office of Food Chemical Safety, Dietary Supplements, and Innovation. The bill was introduced by Senators Edward J. Markey (D-MA), Cory Booker (D-NJ), Richard Blumenthal (D-CT), and Elizabeth Warren (D-MA) on December 4, 2023.

The U.S. Food and Drug Administration’s (FDA) recently released final guidance, titled, “Registration and Listing of Cosmetic Product Facilities and Products,” provides information to be included with registration and listing submissions required under the Modernization of Cosmetics Regulation Act of 2022 (MoCRA).

The California Environmental Protection Agency’s Office of Environmental Health Hazard Assessment (OEHHA) Developmental and Reproductive Toxicant Identification Committee (DARTIC) voted 9-0 in favor of listing bisphenol S (BPS) as a reproductive toxicant (female reproductive endpoint) under Proposition 65 at its December 12 meeting.

Minnesota’s ban on intentionally added per- and polyfluoroalkyl substances (PFAS) in food packaging becomes effective on January 1, 2024. (See Minn. Stat. § 325F.075.) The ban was included in an omnibus environment, natural resources, and tourism bill that was signed into law on June 29, 2021. We previously reported on the law here.

The U.S. Environmental Protection Agency (EPA) recently announced several proposed changes to its Safer Choice Standard. Among the proposed changes are provisions to strengthen sustainable packaging requirements that the Agency explained were made in “response to consumer demand and innovations in packaging materials and technologies.” The proposed changes concerning primary packaging are listed below.

A Canadian federal judge ruled that the inclusion of all plastic manufactured items (PMI) as “toxic substances” under the Canadian Environmental Protection Act (CEPA) is both “unreasonable and unconstitutional.” The challenge, considered by the Court, was brought by a coalition of plastics companies in Responsible Plastic Use Coalition v.
